Rule 114 “Other”
This catch-all category in Rule 114, which covers Alternative Dispute Resolution processes, allows parties to design a process that fits their particular needs. A Parenting Consultant is often appointed under this provision as there is no statute governing it.
Attorneys and judges are often very innovative, creating hybrids of these roles to serve the special needs of the individual family. However, it is very important that the designed process is clearly understood. Particular attention should be paid to whether the process is to be binding or non-binding, and what confidentiality, if any, attaches to the process.
